Curava Limited Warranty

Curava will warrant to the original purchaser of installed Curava products for a period of ten (10) year from the original date of installation that the products will be free from manufacturing defects, provided the surfaces are fabricated and installed by a Curava Authorized Fabricator. A list of Curava Authorized Fabricators can be obtained by calling Curava at 1-800-449-0356 or by checking with your Curava Authorized Dealer. This warranty covers repair or replacement of the failed surface product that has been permanently installed. The warranty includes direct labor charges necessary to repair or replace the product covered by this warranty.

The limited ten-year warranty is available only to the owner of a commercial building or single-family residence in which the Curava product is originally installed, or, in the case of a newly constructed single-family residence, to the first owner acquiring the residence from the builder thereof with the surface product already permanently installed.

Warranty does not apply to defects or issues arising as a result of improper installation.

Terms and Conditions

This warranty applies only to Curava products.

This warranty applies only to installations that are permanently installed and that have not been removed from their original installation location.

This warranty does not cover products that have not been paid for in full.

This warranty only applies to surface products that have been maintained according to Curava’s surface care instructions, which can be found at http://www.curava.com/products/maintenance

To request service under this warranty, you must contact the entity from which you purchased your Curava surfaces or contact Curava’s warranty administrator directly at (800) 449-0356.

You must register your Curava product, either by filling out the warranty registration card provided at the time of installation. In the event that no record of your warranty is on file, you must provide proof of purchase in the form of a copy of your original receipt or invoice showing the name of the Authorized Dealer and Curava Certified Fabricator. You must agree to cooperate with Curava or its authorized agents in the inspection of this product and be willing to assist us in efforts to perform our obligations under this warranty.

The warranty is transferable during the warranty period to any subsequent owner of the residence or commercial property in which the Curava product was originally installed, provided the original purchaser provides Curava with the name of the new owner and contact information. Under no circumstances will this warranty exceed ten (10) years from the original date of installation.

All decisions regarding this warranty are at the sole discretion of Curava and will be communicated to the end user promptly.

Exclusions

Minor conditions such as stains, acid etching and water spots that are a function of proper care and maintenance, and which may be corrected by following the techniques specified in Curava’s Surface Care instructions, are not covered.

Aesthetic variations in color, glass aggregate particle size and glass distribution are expected with the use of recycled materials and are not considered a product defect.

Products installed for outdoor use are not covered.

Damage from Improper Use and Abuse is not covered. This includes, but is not limited to, damage from mishandling or misuse, damage from excessive heat or uneven exposure to weather conditions, physical or chemical abuse, and damage from improper care or maintenance. Abusive treatment to Curava’s edging may result in chipping and loss of glass aggregate. This is not considered a product defect and can often be repaired by an Authorized Curava Fabricator at the customer’s cost.

The warranty is only valid if the Curava product was purchased from an Authorized Curava Dealer and installed by a Certified Curava Fabricator.

This warranty does not cover failures due to fabricators not following the prescribed fabrication or installation procedures outlined by Curava. Improper fabrication or installation is the responsbility of the fabricator/installer.

This warranty does not cover seam appearance or seam performance.

This warranty does not cover additional modifications such as plumbing, electrical, tile, cabinets, etc.., that may be necessary to repair or replace the covered Curava product.

Curava is not responsible for damage or injury caused in whole or in part by acts of God, job site conditions, architectural or engineering design, structural movement, acts of vandalism or accidents.

This warranty does not cover products installed with known or visible manufacturing defects at the time of installation, including but not limited to variance or flatness deviation beyond defined tolerances.

Glass or Cement Chipping.

General Limitations

Curava’s obligation under this limited warranty is limited solely to the repair or replacement of the failed product. Such repair or replacement, however, shall not include the performance of any other repairs or modifications that may be necessary to achieve the actual repair or replacement of the failed surface product (such as, for example, any plumbing, electrical, tile or wall surfacing repairs or modifications). Such other repairs and modifications shall be the responsibility of the customer. If Curava determines the likelihood of failure reoccurrence to be high, Curava retains the option to refund the original purchase price or offer a buy-out financial settlement for the fabricated countertop and/or installation thereof paid by the customer in full and final satisfaction of its warranty obligation hereunder.

In order to obtain service under this limited warranty, you must permit your Certified Curava Fabricator or Curava’s authorized agents to inspect your Curava product at the residence or business. You must also reasonably cooperate with your fabricator and Curava agents in the efforts to service this limited warranty.

Except to the extent expressly stated herein or otherwise required by applicable law, Curava disclaims all warranties and representations, expressed or implied, statutory or otherwise, including without limitation, any implied or expressed warranties of non-infringement of third party rights, satisfactory quality, merchantability or fitness for a particular purpose, and Curava shall not be responsible or liable in either contract or tort, and whether or not Curava has been advised of the possibility of such loss or damage, for any loss or damage, including, without limitation, direct, indirect, special, consequential or incidental damages, arising out of the inability to use or delays in installation of, or repairs to the products manufactured by Curava.

This is the only warranty offered by Curava for its products. No one other than Curava is authorized to make any warranty or promise with respect to Curava products.
